Terms of Service

Welcome to Zackie. By downloading, installing, or using Zackie ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Zackie AI ("we," "our," or "us"). By accessing or using the App, you confirm that you are at least 13 years of age and have the legal authority to enter into these Terms.

2. Description of Service

Zackie is a voice-to-text productivity application available on iOS and macOS. The App provides:

  • Voice dictation and speech-to-text transcription
  • A custom keyboard extension for use across apps
  • AI-powered text processing features
  • Custom dictionary for personalized transcription corrections

3. User Accounts

To access certain features, you must create an account using Apple Sign-In. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions & Payments

Free Tier

Zackie offers a free tier with limited transcription usage. The free tier is subject to word count limits that may change at our discretion.

Zackie Pro

Zackie Pro is a paid subscription that provides unlimited transcription and access to premium features. Subscriptions are processed through Apple's App Store and are subject to Apple's terms and billing policies.

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • You can manage and cancel your subscription through your Apple ID account settings.
  • Refunds are handled according to Apple's refund policy.

5. Acceptable Use

You agree not to use Zackie to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Transmit harmful, threatening, abusive, or offensive content
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App's servers or infrastructure
  • Use the App for any illegal or unauthorized purpose
  • Circumvent or attempt to circumvent usage limits or security measures

6. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, code, and design — are owned by Zackie AI and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

You retain full ownership of any text you create or transcribe using the App.

7. Third-Party Services

Zackie integrates with third-party services to provide its functionality:

  • OpenAI Whisper API: Used for speech-to-text transcription. Subject to OpenAI's Terms of Use.
  • Supabase: Used for authentication and data storage.
  • Apple Sign-In: Used for user authentication. Subject to Apple's terms.

We are not responsible for the practices or policies of third-party services.

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

  • The accuracy, reliability, or completeness of transcriptions
  • Uninterrupted or error-free operation of the App
  • Fitness for a particular purpose
  • The security of data transmitted through the App

Speech-to-text transcription is inherently imperfect. You are responsible for reviewing and verifying all transcribed text before use.

9. Limitation of Liability

To the maximum extent permitted by law, Zackie AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data, profits, or business opportunities
  • Errors or inaccuracies in transcriptions
  • Unauthorized access to or alteration of your data
  • Service interruptions or downtime

Our total liability for any claim arising from or relating to these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Zackie AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:

  • Your right to use the App ceases immediately
  • We may delete your account and associated data
  • Provisions that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) shall continue to apply

12. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of California.
